   Check Documents before buying property

New Delhi-Buy property at a glance seems easy-select your desired property or land, pay price and own it. The first part that of selecting property although time consuming is simple. What is more  difficult and an absolute must is to verify the authenticity of the property papers. Lawyers and land owing government agency that property buyers should check the property documents thoroughly even before they give any advance payment to the seller, else should the documents not to be correct or incomplete they would be stuck with a problem.

In Delhi there are broadly five categories of property-residential, commercial, lal dora, agricultural and industrial. There are over half a dozen land owing agencies-free hold, land and development office, Delhi development authority (DDA), Delhi State Development Corporation (DSIDC), Waqf Board, Delhi government and lastly land which is governed by Punjab Act. There is also property in the NCR -Faridabad,  Noida, Greater Noida, Gurgoan and Ghaizabad. Land laws of the respective states it comes under govern properties in the NCR area. Property papers can vary in accordance with the rules of the concerned land owing agency.

A large number of Delhi properties are freehold. This in effect means that the property including the land it occupies belongs to the owner. It is distinct from leasehold property, in which the property land is given on a lease of a specified number of years to the owner by the land owing agency. The buyer should get from the seller a photocopied set of papers of the property.  These include-Title Deed, Ownership document, Completion certificate in case of a house or building, Form C,D and more recently B-I- relating to electrical conduiting   and sanitation, Building plans which have been sanctioned by the concerned authority. Latest house tax receipt, Last paid water and electricity bills.

Once the set of property papers are obtained the buyer needs to check that they are genuine by tallying them with the records in various government departments. Title Deeds would need to be verified from the earlier land owing agency, the sanctioned building plans and completion certificate from the buildings departments of civic bodies the area falls under be it MCD, NDMC or DDA, and house tax payments from the house tax departments of the concerned agency like MCD or NDMC. Likewise water and electricity bill payments should be tallied from billing sections of BSES, NDPL and Jal Bord or related departments in civic bodies like NDMC.  For those who know little about property matters the best way to verify property documents is to consult a lawyer or a reputed property dealer.
